Scheduled Reports - Execute only when there is data available configuration not being followed

Description
When configuring a scheduled report and we enable Execute only when there is data available option in the Details section, this option is not being considered and it is sending the report without any issues being returned in the JQL

Pre-conditions

How to reproduce

1. Create a scheduled report
2. In the Details enable the option  Execute only when there is data available
3. In the JQL expression, set an expression that does not return any issues
4. Configure an action to send email
5. Click apply Changes

Actual result/Attachments

The report is being sent to the emails with a blank report 

Expected result

The report will only be sent if there are issues found in the JQL Expression
